Soldiers were supplied with combat earplugs that were designed to protect their ears from harsh noises and damage that occur during combat. The earplugs were found to be defective.
Due to design flaws, the earplugs were inhibited from proper insertion into the users' ears. They could not maintain a tight seal which exposed the soldiers to dangerously loud sounds. Many soldiers that used the 3M® Dual-Ended Combat Arms Earplugs Version 2 (CAEv2) reported hearing loss and tinnitus after using them during combat due to faulty design.
3M® agreed to a settlement of $9.1 million to resolve claims that their CAEv2 earplugs caused hearing loss and tinnitus in users.

A whistleblower lawsuit accused 3M® of knowingly selling defective earplugs to the US military without disclosing defects that decreased their effectiveness in blocking out loud noises. The earplugs, called Combat Arms Earplugs (CAEv2), were standard issue to military personnel between 2003 and 2015.
As a result of the alleged defects, thousands of veterans and active-duty service members filed lawsuits against 3M®. They agreed to pay $7.1 million to settle a lawsuit brought by the state of New Jersey, which accused the company of deceptive marketing and false claims about the earplugs' effectiveness.
Some of these lawsuits have already gone to trial, with juries awarding millions of dollars in damages to plaintiffs. Overall, the 3M® earplug lawsuit has been a significant legal issue for the company, and it may continue to face legal action and financial damages as more cases are brought to trial.
